Trump administration cannot require states to cooperate with ICE to get transportation funding, choose says

A federal choose on Thursday blocked the Trump administration from requiring nearly two dozen principally Democratic states to cooperate with federal immigration authorities with a purpose to obtain billions in transportation funding.

Transportation Secretary Sean Duffy warned in April his division could lower off grants to any recipients that fail to “cooperate usually with Federal authorities within the enforcement of Federal regulation” — a part of a wider gambit to push again in opposition to “sanctuary” jurisdictions.

A bunch of 20 states sued, arguing the administration does not have the authorized authority to tie transportation {dollars} — which states depend on for maintenance of roads, airports and different infrastructure — to immigration enforcement.

U.S. District Decide John McConnell sided with the 20 plaintiff states on Thursday, issuing a preliminary injunction that barred the federal government from implementing the brand new immigration guidelines for “the States and their governmental subdivisions” whereas the lawsuit works its approach via court docket.

The coverage, McConnell wrote, “is unfair and capricious in its scope and lacks specificity in how the States are to cooperate on immigration enforcement in change for Congressionally appropriated transportation {dollars} — grant cash that the States depend on to maintain their residents safely and effectively on the highway, within the sky, and on the rails.”

The Rhode Island choose added that “Congress didn’t authorize or grant authority to the Secretary of Transportation to impose immigration enforcement circumstances on federal {dollars} particularly appropriated for transportation functions.”

California Legal professional Basic Rob Bonta, whose state was one of many 20 plaintiffs, lauded the choice in an announcement, saying President Trump has tried to “coerce state and native governments into doing his bidding.”

“President Trump is threatening to withhold vital transportation funds except states agree to hold out his inhumane and illogical immigration agenda for him. He’s treating these funds – funds that go towards enhancing our roads and preserving our planes within the air – as a bargaining chip,” Bonta wrote.

CBS Information has reached out to the White Home and Division of Transportation for remark.

The Trump administration has threatened to chop off some federal funding to “sanctuary” jurisdictions, or cities and states that restrict native police from cooperating with federal immigration authorities. The administration argues these insurance policies make it more durable for businesses like Immigration and Customs Enforcement to apprehend undocumented immigrants, together with these with legal information. However some jurisdictions say that if native police are compelled to cooperate with ICE, immigrants could also be much less prone to belief police.

In April, a federal choose in San Francisco blocked the Trump administration from implementing government orders threatening to tug funds from “sanctuary cities.”

Duffy wrote on X earlier this week that his division “will NOT fund rogue state actors who refuse to cooperate with federal immigration enforcement.”

“And to cities that stand by whereas rioters destroy transportation infrastructure — do not anticipate a purple cent from DOT, both. Observe the regulation, or forfeit the funding,” Duffy added, possible referring to protests in opposition to ICE in Los Angeles and different cities.
