Noting the proof earlier than it, the discussion board, in an order dated July 9, made out there lately, stated, “We maintain that the alternative social gathering (Indigo) was responsible of deficiency in service.”
“As regards the discomfort and ache, psychological agony suffered by her, we’re of the view that she should be compensated. We accordingly direct the alternative social gathering to pay ₹1.5 lakh as compensation for psychological agony, bodily ache and harassment to her,” the discussion board added.
It additionally directed fee of ₹25,000 as litigation bills.
In its order, the discussion board stated that the airways had failed to provide the Scenario Knowledge Show (SDD) report, which fashioned part of its inner operational information as per customary aviation protocols.
It stated, “There is no such thing as a reference to this report within the written assertion or within the proof filed by the alternative social gathering. The SDD is an important doc used for flight operation monitoring and to report passenger-related incidents. The absence of this doc considerably weakens the alternative social gathering’s defence.”
